Terms of Use (EULA)

1. Acceptance of terms

By accessing or using the FitIQ mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and FitIQ (“we”, “us”, or “our”).

2. Description of service

FitIQ is a mobile application that provides, among other things:

• Body shape analysis through photo uploads
• Personalized style and outfit recommendations
• Wardrobe management and analytics
• Style goal tracking and insights
• Premium subscription features for enhanced functionality

3. User accounts and registration

To access certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us promptly of any unauthorized use or suspected breach

4. Free and premium features

4.1 Free tier

The free tier may include, for example:

• 3 body scans per month
• 3 style suggestions per month
• Up to 10 wardrobe items
• Basic analytics and insights

4.2 Premium subscription

Premium subscriptions may include, among other benefits:

• Unlimited body scans
• Unlimited style suggestions
• Unlimited wardrobe items
• Advanced analytics and insights
• Priority customer support
• Data export capabilities

5. Subscription terms

Premium subscriptions are available as monthly or yearly plans (e.g., $2.99/month or $29.99/year, subject to change):

• Subscriptions automatically renew unless cancelled in accordance with App Store terms
• Cancellation must typically occur at least 24 hours before the renewal date
• Refunds are governed by the respective App Store’s refund policies
• Price changes will be communicated where required and will take effect at the next billing cycle

6. User content and privacy

By using the App, you may upload photos and personal information. You agree that:

• You own or have all necessary rights to the content you upload
• Your content does not infringe any law or third‑party rights
• We may process your data as described in our Privacy Policy
• You consent to our collection and use of your information for providing and improving the service

7. Acceptable use

You agree not to:

• Use the App for any illegal, harmful, or unauthorized purpose
• Upload content that is unlawful, offensive, or violates rights of others
• Attempt to gain unauthorized access to our systems or other users’ accounts
• Interfere with or disrupt the App, servers, or networks
• Reverse engineer, decompile, or attempt to extract the App’s source code, except where allowed by law
• Use the App to harass, abuse, or harm any person or entity

8. Intellectual property

The App and its content (including text, graphics, images, logos, and software) are owned by FitIQ or its licensors and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without prior written permission
• Use our trademarks, logos, or branding without authorization
• Remove, obscure, or alter any copyright or proprietary notices

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Accuracy, completeness, or reliability of style recommendations
• Uninterrupted, timely, secure, or error‑free operation
• Compatibility with all devices, operating systems, or configurations
• Security of data transmission or storage, although we take reasonable safeguards

10. Limitation of liability

To the maximum extent permitted by law, FitIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or goodwill
• Personal injury or property damage related to use of the App
• Business interruption or loss of business opportunities
• Any damages resulting from your reliance on information provided by the App

11. Indemnification

You agree to indemnify and hold harmless FitIQ, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your infringement of any third‑party rights

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the App ceases immediately
• We may delete or deactivate your account and associated data, subject to legal obligations
• Any provisions of these Terms that by their nature should survive termination will remain in effect

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Local consumer protection or data protection laws may also apply depending on your jurisdiction.

14. Changes to these terms

We may modify these Terms from time to time. When we make material changes, we will notify you by updating the “Last updated” date, and, where appropriate, by providing an in‑app notice. Your continued use of the App after changes take effect means you accept the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. Entire agreement

These Terms, together with our Privacy Policy and any additional terms presented in the App, constitute the entire agreement between you and FitIQ regarding your use of the App.
