FitIQ Terms of Use (EULA)

1. Acceptance of Terms

By accessing or using the FitIQ mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and FitIQ ("we," "us," or "our").

2. Description of Service

FitIQ is a mobile application that provides:

• Body shape analysis through photo uploads
• Personalized style recommendations
• Wardrobe management and analytics
• Style goal tracking and insights
• Premium subscription features for enhanced functionality

3. User Accounts and Registration

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your account credentials secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Free and Premium Features

Free Tier:

• 3 body scans per month
• 3 style suggestions per month
• Up to 10 wardrobe items
• Basic analytics and insights

Premium Subscription:

• Unlimited body scans
• Unlimited style suggestions
• Unlimited wardrobe items
• Advanced analytics and insights
• Priority customer support
• Data export capabilities

5. Subscription Terms

Premium subscriptions are available as monthly ($2.99) or yearly ($29.99) plans:

• Subscriptions automatically renew unless cancelled
• Cancellation must be made at least 24 hours before renewal
• Refunds are subject to App Store policies
• Price changes will be communicated in advance

6. User Content and Privacy

By using the App, you may upload photos and personal information. You agree that:

• You own or have permission to use all uploaded content
• Content does not violate any laws or third-party rights
• We may process your data as described in our Privacy Policy
• You consent to our collection and use of your information

7. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Upload inappropriate, offensive, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer or attempt to extract source code
• Use the App to harass, abuse, or harm others

8. Intellectual Property

The App and its content, including but not limited to text, graphics, images, logos, and software, are owned by FitIQ and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Remove or alter any copyright notices

9. Disclaimers and Limitations

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including but not limited to:

• Accuracy of style recommendations
• Uninterrupted or error-free operation
• Compatibility with all devices or operating systems
• Security of data transmission or storage

10. Limitation of Liability

To the maximum extent permitted by law, FitIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Personal injury or property damage
• Business interruption
• Any damages resulting from your use of the App

11. Indemnification

You agree to indemnify and hold harmless FitIQ from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and data
• Provisions of these Terms that survive termination remain in effect

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitIQ regarding the use of the App.
